Terms of Service

1. Agreement
By purchasing credits or making any API request to VerifyMail ("Service", "we", "us"), you ("Customer", "you") agree to these Terms of Service in their entirety. If you are acting on behalf of a company or legal entity, you represent that you have the authority to bind that entity to these terms. If you do not agree, do not use the Service.
2. Service Description
VerifyMail is a programmatic email verification API. Customers purchase credits in advance and consume one credit per verification request. Each request returns a JSON response indicating whether the supplied email address is syntactically valid, has functioning MX records, or should be treated as risky when MX lookup results are inconclusive.
VerifyMail is a technical tool, not a marketing or communication platform. We do not send emails to end users on your behalf.
3. API Usage & Credits
- Credits are pre-purchased and non-refundable once consumed by a successful API response (HTTP 200).
- Credits do not expire within 12 months of purchase. Unused credits may be forfeited after 12 months of account inactivity.
- Each credit entitles you to one verification request. Requests that return an HTTP 4xx or 5xx error code do not consume a credit.
- Rate limits apply: 60 requests per minute per API key by default. Contact us to discuss higher limits.
- API keys are personal and must not be shared publicly (e.g., in client-side code, public repositories, or documentation).
4. Acceptable Use Policy
You agree not to use VerifyMail to:
- Harvest, scrape, or enumerate email addresses from third-party systems without authorization.
- Verify lists obtained through data breaches, unauthorized access, or without the subjects' consent.
- Facilitate spam, phishing, or any unsolicited bulk communications.
- Circumvent the rate limits or security measures of the API.
- Resell or sublicense raw API access to third parties without prior written agreement with VerifyMail.
- Use the Service in any manner that violates applicable law, including GDPR, CAN-SPAM, CASL, or similar regulations.
Violation of this policy may result in immediate suspension of your API key without refund of unused credits.
5. Service Level Agreement (SLA)
We target 99.5% monthly API uptime, excluding scheduled maintenance windows (announced at least 24 hours in advance via verifymail.nanocorp.app/status).
In the event that verified downtime exceeds the target in a calendar month, affected customers may request a credit of 5% of their monthly spend per each additional hour of downtime, up to a maximum of 30% of the monthly spend. Credit requests must be submitted within 30 days of the incident.
Downtime caused by third-party providers, DDoS attacks, customer misuse, or force majeure events is excluded from SLA calculations.
6. Payment Terms
- All payments are processed by Stripe via NanoCorp. By completing a purchase you also agree to Stripe's terms of service.
- Prices are displayed in USD and do not include applicable taxes (VAT, GST, sales tax). You are responsible for any applicable taxes in your jurisdiction.
- Credits are non-transferable between accounts.
- We reserve the right to change pricing with 30 days' notice for future purchases. Purchased credits are not affected by price changes.
- Chargebacks initiated without first contacting us will result in immediate account suspension.
7. Intellectual Property
All rights in the VerifyMail API, documentation, and website are owned by or licensed to VerifyMail. These Terms grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes.
You retain ownership of any data you submit to the API (email addresses for verification). You grant VerifyMail a limited license to process this data solely to provide the Service.
8. Limitation of Liability
The Service is provided "as is" and "as available". We make no warranties, express or implied, regarding accuracy of verification results, fitness for a particular purpose, or uninterrupted availability.
To the maximum extent permitted by applicable law, VerifyMail's total liability for any claim arising from these Terms or your use of the Service is limited to the amount you paid us in the 3 months preceding the claim. In no event are we liable for indirect, incidental, special, consequential, or punitive damages.
9. Termination
Either party may terminate this agreement at any time. Upon termination, your API key will be disabled. Unused credits at termination are non-refundable unless termination is due to a material breach by VerifyMail.
We may suspend or terminate your access immediately and without notice if we reasonably believe you are violating these Terms or applicable law.
10. Governing Law
These Terms are governed by the laws of France. Any disputes shall be resolved exclusively in the courts of Paris, France, except where mandatory local consumer protection law requires otherwise.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after the effective date of changes constitutes your acceptance of the new Terms. For material changes, we will notify customers via email or a banner on the website at least 14 days in advance.
